POLITYKA PRYWATNOŚCI I WYKORZYSTYWANIA PLIKÓW COOKIES

Niniejsza polityka prywatności i wykorzystywania plików cookies (dalej: „Polityka Prywatności”) stanowi zbiór zasad przetwarzania danych osobowych i zbierania plików cookies na stronach internetowych Restauracje Zakopane (dalej: „Serwis”).

Niniejsza Polityka Prywatności jest adresowana wszystkich osób, które odwiedzają stronę www.stekchalupa.pl, kontaktują się z Administratorem Danych Osobowych (telefonicznie, mailowo, przez formularz kontaktowy), są pracownikami, współpracownikami lub reprezentantami kontrahentów Administratora Danych Osobowych (dalej: “Użytkownicy”).

Przed rozpoczęciem korzystania z Serwisu, Użytkownik powinien zapoznać się z Polityką Prywatności. Polityka Prywatności określa zasady przetwarzania i ochrony danych osobowych osób korzystających z Serwisu. Celem Polityki Prywatności jest m.in. realizacja obowiązku informacyjnego, o którym mowa w art. 13 ust. 1 i 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (Ogólne Rozporządzenie o Ochronie Danych), dalej: „RODO”.

POLITYKA PRYWATNOŚCI

1. Administrator danych

Administratorem danych osobowych Użytkowników jest REMO spółka z ograniczoną odpowiedzialnością spółka jawna z siedzibą w Krakowie (KRS: 0000477381), Plac na Groblach 21, 31-101 Kraków (dalej: „Administrator”). Użytkownicy mogą skontaktować się z Administratorem w następujący sposób:

2. Inspektor ochrony danych

Nie wyznaczyliśmy inspektora ochrony danych.

3. Cele przetwarzania danych osobowych oraz podstawa prawna przetwarzania

Dane osobowe Użytkowników będą przetwarzane w następujących celach i w oparciu o poniższe podstawy prawne:

Udzielanie odpowiedzi na zapytania kierowane przez Użytkowników oraz kontaktowanie się z Użytkownikami w sprawach, z którymi zwrócili się do Administratora korzystając m.in. z formularza kontaktowego lub wysyłając wiadomość na adres e-mail Administratora. Podstawą prawną przetwarzania danych jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO), polegający na potrzebie udzielenia odpowiedzi Użytkownikom.

Kontaktowanie się z Użytkownikami w sprawach bieżących, w tym w szczególności w zakresie wykonywania umów między Administratorem a Użytkownikiem, pracodawcą Użytkownika lub podmiotem, który Użytkownik reprezentuje, przedstawianie ofert, otrzymywanie zamówień oraz zleceń, udzielanie odpowiedzi na pytania. Podstawą prawną przetwarzania danych jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO), polegający na potrzebie bieżącego kontaktu z kontrahentami Administratora.

Realizacja umów zawartych między Administratorem a Użytkownikiem, pracodawcą Użytkownika lub podmiotem, który Użytkownik reprezentuje, w tym przyjmowanie i realizacja zamówień, składanie zamówień, zawieranie umów, dokonywanie czynności z zakresu rachunkowości, obsługa księgowa, windykacja należności. Podstawą prawną jest niezbędność do wykonania umowy lub podjęcia działań przed zawarciem umowy z Użytkownikiem (art. 6 ust. 1 lit. b RODO), a także prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO), polegający na potrzebie prawidłowej realizacji umów z kontrahentami.

Wypełnianie obowiązków prawnych ciążących na Administratorze, w tym w szczególności wynikających z przepisów prawa podatkowego (podstawa prawna – art. 6 ust. 1 lit c RODO).

Ustalenie, zabezpieczenie i dochodzenie ewentualnych roszczeń zarówno po stronie Administratora jak i Użytkownika. Podstawą prawną jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO), polegający na możliwości ustalenia, dochodzenia lub obrony roszczeń.

4. Odbiorcy danych (kategorie odbiorców)

Dane osobowe Użytkowników mogą być udostępniane podmiotom zewnętrznym świadczącym na rzecz Administratora usługi, takie jak usługi logistyczne, prawne, audytorskie i księgowe, jak również dostawcom usług informatycznych, w tym poczty elektronicznej. Administrator może udostępnić dane osobowe jedynie podmiotom, z którymi posiada zawartą umowę powierzenia przetwarzania danych osobowych. Dane osobowe Użytkowników nie będą przekazywane do państwa trzeciego lub organizacji międzynarodowej.

5. Okres przechowywania danych osobowych

Będziemy przechowywać dane Użytkowników przez okres niezbędny do realizacji określonych powyżej celów. Jeżeli:

dane osobowe Użytkownika są przetwarzane w związku z wykonaniem umowy zawartej z Użytkownikiem, jego pracodawcą lub podmiotem, którego Użytkownik reprezentuje będziemy je przechowywać przez okres wykonywania umowy oraz w zakresie w jakim jest to niezbędne – przez 5 lat licząc od końca roku kalendarzowego, w którym upłynął termin płatności podatku należnego w związku z zawarciem i realizacją umowy albo dłużej, jeżeli wymagają tego przepisy prawa.

Użytkownik kontaktował się z Administratorem – jego dane będą przetwarzane przez okres niezbędny dla celów kontaktowania się z Użytkownikiem oraz przez okres 1 roku od zakończenia kontaktu.

Jeżeli dane osobowe Użytkownika nie będą już niezbędne do celów, dla których były przetwarzane, Administrator będzie je przechowywał w celu ustalenia, dochodzenia lub obrony przed ewentualnymi roszczeniami zarówno po stronie Administratora jak i Użytkownika jedynie przez okresy przedawnienia roszczeń, określone w przepisach prawa.

6. Konsekwencje niepodania danych osobowych

Poza przypadkami, w których podanie danych osobowych stanowi wymóg prawny, podanie danych osobowych jest całkowicie dobrowolne, jednakże ich niepodanie utrudni lub uniemożliwi nam realizację celów określonych powyżej.

7. Informacja o zautomatyzowanym podejmowaniu decyzji

Dane Użytkowników nie będą przetwarzane w sposób zautomatyzowany, w tym również nie będą przetwarzane w formie profilowania.

8. Prawa związane z przetwarzaniem danych osobowych

Użytkownikowi przysługują następujące prawa związane z przetwarzaniem danych osobowych:

Prawo dostępu do danych osobowych, prawo żądania sprostowania, usunięcia lub ograniczenia przetwarzania danych osobowych, o ile prawa te nie są wyłączone lub ograniczone przez przepisy prawa.

Prawo wyrażenia sprzeciwu wobec przetwarzania danych osobowych ze względu na szczególną sytuację Użytkownika – w przypadkach, kiedy dane osobowe Użytkownika są przetwarzane na podstawie naszego prawnie uzasadnionego interesu.

Prawo do przenoszenia danych osobowych, tj. prawo otrzymania danych osobowych w ustrukturyzowanym, powszechnie używanym formacie informatycznym nadającym się do odczytu maszynowego. Użytkownik może przesłać te dane innemu administratorowi danych lub zażądać, abyśmy przesłali dane do innego administratora. Jednakże zrobimy to tylko, jeśli takie przesłanie jest technicznie możliwe.

PLIKI COOKIES

1. Co to są pliki cookies?

Pliki cookies są danymi internetowymi, w szczególności plikami tekstowymi, które przechowywane są w urządzeniu końcowym (komputerze, telefonie komórkowym, tablecie) Użytkownika. Przede wszystkim zawierają nazwę strony internetowej swojego pochodzenia, swój unikalny numer, czas przechowywania na urządzeniu końcowym. Za pomocą plików cookies dostarczane są Administratorowi informacje statystyczne o ruchu Użytkowników, aktywności Użytkowników i sposobie wykorzystania Serwisu. 2. Do czego służą pliki cookies?

W związku z korzystaniem przez nas z plików cookies, przekazujemy najważniejsze informacje na temat ich zastosowania.

Mechanizm cookies nie jest wykorzystywany do pozyskiwania jakichkolwiek informacji o Użytkownikach, z wyjątkiem informacji o ich zachowaniu na stronach Serwisu.

Administrator przechowuje pliki cookies na komputerach Użytkowników w celu:

a) właściwego dopasowania Serwisu do potrzeb Użytkowników oraz optymalizacji korzystania ze stron internetowych;

3. Jakie mamy rodzaje plików cookies?

Privacy and the policy of the use of cookies

This privacy policy and the policy of the use of cookies (hereinafter “Privacy Policy”) consists of the set of rules that govern the processing of personal data and collecting cookie files on websites of Restauracja Stek Chałupa (hereinafter referred to as  “Service”).

This Privacy Policy is addressed to every person who visits the website www.stekchalupa.pl, contact the Personal Data Controller (by phone, e-mail , or through the contact form), and who are employees, associates, or representatives of the contractors of the Personal Data Controller  (hereinafter referred  to as “Users”).

Prior to using the Service, the User should read the Privacy Policy. The Privacy Policy defines the rules of processing and protecting personal data of persons using the Service. The purpose of the Privacy Policy is, inter alia, to implement the information obligation referred to in Article 13(1) and (2) of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons  with regard to the processing of personal data and on the free movement of such data , and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter  referred to as “GDPR”),

  1. of the processing of personal data and legal basis of the processing

Personal data of  Users will be processed for the following purposes and on the basis of the following legal grounds:

Providing answers to enquiries sent by Users and contacting Users in respect of the matters which they communicated to the Controller using, among others, the contact form or by sending a message to the Controller’s e-mail address. The legal basis for the data processing is the legitimate interest of the Controller (Article 6 (1)(f)of the GDPR), consisting in the need to provide the Users with the answers.

Contacting Users in respect of current matters, including in particular, performance of the agreements between the Controller and the User, Controller’s employee and the entity represented by the User, presenting offers, accepting orders and commissions, replying to enquiries. The legal basis for the data processing is legitimate interest of the Controller (Article 6 (1)(f)of the GDPR), consisting in the need to maintain ongoing contact with the Controller’s contractors.

Implementation of agreements concluded between the Controller and the User, the User’s employer or the entity represented by the User, including acceptance and execution of orders, placing orders, concluding agreements, performing activities in the field of accounting, accounting service, debt collection. The legal basis is the necessity to perform the contract or to undertake actions before concluding the contract with the User (Article 6 (1)(f)of the GDPR), as well as the legally justified interest of the Controller (Article 6 (1) (f)of the GDPR) consisting in the need for proper performance of contracts with contractors.

Compliance with legal obligations of the Controller including in particular those resulting from the provisions of tax law (legal basis – Article 6 (1)(c) of the GDPR).

Determining, securing and asserting potential claims both on the part of the Controller and the User. The legal basis is the Controller’s legitimate interest (Article 6(1)(f) of theGDPR) in the possibility of establishing, asserting or defending claims.

  1. Data recipients (categories of recipients)

Personal data of Users may be disclosed to external entities providing services for the Controller, such as logistic, legal, audit and accounting services, as well as to providers of IT services, including e-mail. The controller may disclose personal data of the Users only to entities with whom it has concluded an agreement entrusting the processing thereof.  Personal data of User will not be transferred to a third country or international organization.

  1. Personal data storage period

We will store your data for the period necessary to fulfill the purposes specified above. If:

the User’s personal data are processed in connection with the performance of the contract concluded with the User, his employer or the entity represented by the User we will store them for the period of the performance of the contract and to the extent necessary – for 5 years from the end of the calendar year in which the due tax due in connection with the conclusion and performance of the contract expired or longer, if required by law.

The User contacted the Controller – his data will be processed for the period necessary for the purpose of contacting the User and for the period of 1 year from the end of contact.

If the User’s personal data is no longer necessary for the purposes for which it was processed, the Controller will store it in order to determine, pursue or defend against possible claims on both the part of the Controller and the User only for the periods of limitation of claims, specified by the relevant provisions of law.

  1. Consequences of not supplying personal data

With the exception of the cases where supplying personal data is required by law, the Users provide their  personal information on voluntary basis, but if the User does not provide such unformation, it will make it more difficult or impossible for us to achieve the purposes set out above.

  1. Information on automated decision-making

User’s data will not be processed in an automated way, including it will not be processed in the form of profiling.

 

  1. Rights related to the processing of personal data

The User has the following rights in relation to the processing of personal data:

Right of access to personal data, right to request rectification, erasure or limitation of the processing of personal data, unless these rights are excluded or limited by law.

The right to object to the processing of personal data due to the specific situation of the User – in cases where the User’s personal data is processed on the basis of our legitimate interest.

The right to transfer personal data, i.e. the right to receive personal data in a structured, common and machine-readable computer format. You may transfer this information to another Data Controller or request that we transfer it to another Data Controller. However, we will only do so if it is technically possible.

The right to lodge a complaint with the authority – the President of the Office for Personal Data Protection.

  1. What are cookies?

Cookies are Internet data, in particular text files, which are stored on the end device (computer, mobile phone, tablet) of the User. First of all, they contain the name of the website of their origin, unique number and the duration of storage on the end device. Cookies are used to provide the Controller with statistical information on the Users’ movements, activity and the manner of using the Service. They allow the content and services to be adjusted to the User’s preferences.

The term “cookie” refers to cookie files  and other similar tools described in Directive 2009/136/EC of the European Parliament and of the Council concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) and Article 173 of the Telecommunications Law.

In connection with the use of cookies by us, we provide you with the most important information about their applications.

The cookie mechanism is not used to obtain any information about Users,  except for the information about their behavior on the Website.

The controller stores cookies on the Users’ computers to:

  1. a) customize the Service to the needs of Users and optimize the use of websites;
  2. b) remember the User’s preferences and individual settings, recognize the User’s device and display the website adjusted to the User’s needs (full version, mobile version of the website) in an appropriate manner;
